For Indian IT professionals hoping to secure a US Green Card through employer sponsorship, changes to the PERM process could make employers’ recruitment and compliance responsibilities more demanding. The US Department of Labor is preparing a proposal to modernize the system, but the changes are not yet final.
According to the US government’s regulatory agenda, the proposed rule focuses on updating how employers recruit qualified American workers before sponsoring foreign employees for permanent positions. The initiative also seeks to strengthen safeguards for US workers affected by layoffs and improve compliance with recruitment, hiring, and record-retention requirements.
What Could Change for Green Card Sponsorship?
PERM, or Program Electronic Review Management, is the labor certification process that many employer-sponsored green card applications must complete. Employers generally need to show that qualified US workers are unavailable for the position and that hiring a foreign worker meets applicable labor protections.
Under the proposed overhaul, employers could face updated recruitment standards and closer scrutiny of their compliance with these requirements. For technology companies sponsoring Indian software engineers and other skilled workers, this could mean additional documentation and more careful planning before submitting applications.
However, the proposal does not mean Indian IT workers will automatically lose their eligibility for US permanent residency. Its practical impact will depend on the detailed provisions eventually published and adopted by the government.
