Leaving the US can affect a pending application
An overseas trip may have consequences if USCIS is still reviewing your immigration paperwork. The effect depends on the type of application and the status you currently hold.
For some change-of-status requests, leaving the United States before a decision is made can cause USCIS to treat the request as abandoned. This can affect applications involving Forms I-129 or I-539, depending on the benefit being requested.
Adjustment-of-status applicants need extra care
If you have filed Form I-485 to become a permanent resident, travelling abroad without approved Advance Parole will generally result in the application being treated as abandoned.
There are exceptions for certain people who maintain eligible nonimmigrant status. For example, some H-1B and L-1 workers may travel and return without Advance Parole, provided they meet the relevant requirements. Eligible dependents may also have exceptions.
Check your case before booking
A receipt notice does not automatically give you permission to leave and re-enter the country. Check whether you need Advance Parole, whether your current visa remains valid, and whether your status allows you to return.
Because a mistake can affect an important application, speak with a qualified US immigration lawyer before travelling.
